SARKKROM TRADING SRL" registered with the Trade Register under no. J40/6719/2007, tax code 21493505, with its registered office in Bucharest, Sector 1, Calea Floreasca, No. 246C, floor 34, Unit A, Sky Tower, telephone number +40 21 745 00 80, (hereinafter referred to as the "Company" or "SARKKROM TRADING SRL"), which operates and manages the physical Tommy Hilfiger stores. These General Terms and Conditions (hereinafter referred to as "GTC") are intended to present in a clear, unambiguous, and intelligible manner, in accordance with the principle of good faith and the provisions governing the validity of legal acts, the terms that govern and regulate the Company's relationship with the visitor and/or customer of the store, in accordance with the relevant consumer protection legislation (Directive 2011/83/EU, Ministerial Decree 5338/2018, Codified Law 2251/1994), Electronic Commerce (D.P. 131/2003) and the Protection of Individuals with regard to the Processing of Personal Data (EU Regulation 2016/679, Laws 2472/1997 and 3471/2006), in force today.
By accessing, browsing, and transacting with the Store, you become a visitor and/or customer of the Store, as long as you complete a transaction. Before continuing your browsing within the Store, please confirm that you have read and fully understood these GTC and that you accept them, as any use and/or transaction from now on with the Company through the Store implies full and unconditional acceptance of these GTC.

SOLD ITEMS – PRICES
The products sold by the Store are products of the Company (hereinafter referred to as "Products"). Their characteristics, as well as other accompanying data (e.g., warranty documents, identity, instructions, etc.) are available and can be found by following the search instructions listed in the Store and selecting the name of the respective product (click). The prices listed in the relevant catalogs next to each product include VAT (19%). These prices refer to the Products and quantities available in the Company's warehouse, while the Store reserves the right to adjust prices without prior notice.
GENERAL TERMS AND CONDITIONS FOR THE USE OF THE GIFT CARD

The electronic gift card is valid only in Romania for the purchase of any product sold in the online store ro.tommy.com. The electronic gift card is issued by SARKKROM TRADING SRL (hereinafter referred to as the "Company" or "SARKKROM TRADING SRL"), which sets the Terms and Conditions of use as it deems appropriate and has the right to modify them at any time.

In order to fulfill the purpose of the electronic gift card, the Company must process the personal data of third parties provided by the sender/purchaser of the electronic gift card and, in particular, the personal data of the electronic recipient. If the sender/purchaser provides personal data of third parties, they guarantee and are responsible for informing the recipient about the purposes and manner in which the Company must process their personal data and for obtaining their explicit consent for the disclosure of their data, the purpose for which it is provided, and the manner in which it is processed. The sender-purchaser is solely responsible for notifying and obtaining the above consent, guaranteeing the Company that they have this consent. If you have purchased the gift card for a third party, the personal data of the third party that you provide to the Company will be used for the following purposes: a) managing the shipment of the gift card and b) responding to any questions or requests that may be made by the third party.

The value of the electronic gift card can be paid using any payment method accepted on the ro.tommy.com website. Electronic gift cards cannot be purchased using another gift card. The discount code/coupon cannot be used to purchase a gift card.

The electronic gift card can be used only once by its holder, only electronically in the SARKKROM TRADING SRL online store (ro.tommy.com). If the purchase price of a product exceeds the amount available on the electronic gift card, the difference can be paid using any payment method accepted in the ro.tommy.com online store. If the purchase price of a product does not exceed the amount available on the electronic gift card, the order cannot be successfully completed.

The electronic gift card is valid for 6 months from the date it was sent to the recipient. After the expiration date, the electronic gift card cannot be used to purchase products. Similarly, its validity cannot be extended before its expiration.

The holder is solely responsible for the safe use and storage of the gift card. The electronic gift card cannot be replaced in the event of theft of the code and/or unauthorized use, loss, or destruction.

SARKKROM TRADING SRL is not liable if the recipient does not receive the electronic gift card or receives it late for reasons beyond the control of SARKKROM TRADING SRL, including, but not limited to, the following cases: (a) defects or malfunctions of telecommunications, internet, and email lines/systems; (b) a delay in the retransmission of information or data or the loss of information or data that may occur under the conditions set out in point (a) above; c) inaccuracy of the data of the recipient of the electronic gift card provided by the sender/purchaser of the electronic gift card or the fact that the email address sent by SARKKROM TRADING SRL may be considered spam or unwanted correspondence, e) the recipient has chosen not to receive the electronic gift card.

Electronic cards or other types of gift cards (e.g., credit invoices) purchased from the outset in a manner other than that described in these Terms of Use are void and cannot be used to purchase products.

The return of any electronic Gift Card, provided that it has not yet been used, is accepted under the following conditions: Electronic Gift Cards purchased through ro.tommy.com may be canceled within 14 CALENDAR DAYS from the date of purchase and delivery to the recipient. The buyer's withdrawal must be notified in writing to SARKKROM TRADING SRL, either by telephone to the Customer Service Department or by email on the e-shop website. The price paid for the purchase of the gift card will be refunded in the same way as it was used for the purchase. The return time varies depending on the bank and the type of credit card. In this case, its use is canceled, and the recipient has no right to use it.

An electronic gift card obtained in any other country or through the online store accessed from another country cannot be used at ro.tommy.com or in stores in Romania. The current balance of the Gift Card is not refundable or exchangeable for cash.

In the event of a full return of an order in accordance with the General Terms and Conditions of Sale of the online store, which was made through the online store ro.tommy.com and for which an electronic gift card was used, the return is processed in the same way as the purchase was made. The money is returned to the customer for the part of the transaction that was paid for, and for the amount that was covered by the electronic gift card, the customer is returned a credit of the same value, which they can use on their next order.

In the case of partial return of an item from an order in accordance with the General Terms and Conditions of Sale of the online store made through the online store ro. tommy.com and for which an electronic gift card was used, the refund to the customer always precedes and if part of the transaction was made using an electronic gift card, the customer is returned a credit with the corresponding value that they can use on their next order.

Coupons with amounts credited as a result of the above returns will be sent by email to the address of the customer who returned the purchase made with the electronic gift card, and the customer will be solely responsible for the validity of the email address they provided.

In case of refusal to receive an order placed through the online store ro.tommy.com, which has as a payment method the use of an electronic gift card, then the gift card code is reactivated to be used for the next order and the expiration date remains the same as the one initially issued, i.e. six months.
The purchase and/or use of the Gift Card implies full acceptance of the above terms and conditions, which are available in the online store at ro.tommy.com.
ADVERTISING MESSAGES
The store offers you, its visitors/customers, the opportunity to choose to be informed about the Company's new Products, as well as any other offers and services of the Company, by sending advertisements - informative messages by e-mail or post or to the telephone number provided. The store will not abuse the above-mentioned service under any circumstances. You always have the option to discontinue this service by sending a relevant request to the email address tommy.contact@sarkkrom.ro.
INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
Except as expressly stated (third-party copyrights, partners, and entities), the entire content of the site, including images, graphics, photographs, drawings, text, overall appearance, services, and Products provided, and in general, all archives of the Store are intellectual property, industrial designs, signs, symbols, and registered trademarks and service marks of the Company, its affiliates, and its suppliers, and are protected in accordance with the relevant provisions of Greek and European law, as well as international conventions. Other products or services that may be referred to in the Store and bear the marks of the respective organizations, companies, partners, agencies, associations, or publications are their intellectual and industrial property and, therefore, their responsibility. Â
RESPONSIBILITY OF THE PARTIES
As a visitor/customer, by accepting these TCG and browsing the Store, you responsibly declare that you are legally competent to enter into this contract and to use the Store under the terms and conditions set forth herein.
APPLICABLEÂ LAW AND OTHER TERMS
The Company and the Store reserve the right to modify or renew these TCG in writing without prior notice, which shall be valid from the date of display in the Store. Failure to exercise any right of the Company shall not be construed as a waiver thereof.
It is expressly provided that Greek law shall apply. For any dispute that may arise from these Terms, the courts of Athens shall have exclusive jurisdiction.
ELECTRONIC DISPUTE RESOLUTION
The company, in accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013 on online dispute resolution for consumer disputes, Directive 2013/11/EU of the European Parliament and of the Council on alternative dispute resolution for consumer disputes, informs you of the possibility of out-of-court settlement of any dispute related to your transactions with the Store through the European Commission's online dispute resolution platform here.
If any provision of the above terms becomes contrary to the law, it shall automatically cease to be valid and shall be removed from this document, without affecting the validity of the other terms in any way.
