ART. 1. ORGANIZER AND REGULATION

  1. The Organizer of the promotional campaign “SUMMER SALES” – OUTLET – 18.06.2026 – 31.08.2026 hereinafter referred to as the “Campaign” or the “Promotion” is SARKKROM TRADING S.R.L., with its registered office in Bucharest, Sector 1, Calea Floreasca no. 246C, Sky Tower Building, 34th floor, units A and A1, registered with the Bucharest Trade Registry under no. J2007006719400 dated 02.04.2007, having tax identification code 21493505.
  2. The participants in the Campaign are required to comply with the terms and conditions of this Official Regulation hereinafter referred to as the “Official Regulation”.
  3. The Official Regulation is prepared and will be made available to the public in accordance with the applicable legislation, being available free of charge to any requester throughout the entire duration of the Campaign, by the following means:
  • by accessing the campaign link available on the official website ro.tommy.com;
  1. The Organizer reserves the right to amend this Regulation during the Campaign, to suspend or terminate it, with the obligation to officially inform the public in the same manner in which the initial information was communicated, at least 24 hours before the changes come into force.
  2. By participating in the Campaign, participants are presumed to accept the Regulation and are required to fully comply with the established terms and conditions.
  3. Online participants understand and accept that the website may only be used in compliance with the terms and conditions and after being informed regarding the Privacy Policy.

 

ART. 2. CAMPAIGN DURATION AND AREA OF IMPLEMENTATION

  1. The promotional Campaign will take place for online purchases and in the participating OUTLET stores mentioned in Annex 2, with the eligible outlet products being listed in Annex 3, which forms an integral part of this Regulation.
  2. The promotional Campaign will run during the period 18.06.2026 – 31.08.2026.
  3. After the date of 31.08.2026, Sarkkrom Trading S.R.L. shall have no responsibility and assumes no obligation in relation to any circumstance that could potentially lead interested persons to conclude that the promotional Campaign is still valid or continuing.
  4. All products granted within this promotional Campaign must be purchased in accordance with the provisions of this Regulation; otherwise, they shall no longer be owed by the Organizer.
  5. The Promotion is valid within the limit of available product stock.

 

ART. 3. RIGHT TO PARTICIPATE IN THE CAMPAIGN

  1. The promotional Campaign is addressed to the general public, namely individuals who have reached the age of 18 by the start date of the Campaign, inclusive, Romanian citizens or foreign citizens residing on the territory of Romania, with stable domicile / residence in Romania, who accept the terms and conditions of this Official Regulation hereinafter referred to as “Participants” and make purchases in accordance with the Campaign conditions.
  2. The Organizer reserves the right to remove any attempted fraud by restricting access to participate in this promotional Campaign for persons attempting to commit fraud.
  3. By participating in the Campaign, participants agree that their personal data shall be processed by Sarkkrom Trading S.R.L. in its own name, under the conditions provided in Annex 1 to this Regulation.
  4. The following persons may not participate in the Campaign: employees of the Organizer.

 

ART. 4. PARTICIPATING PRODUCTS

  1. The Campaign applies to products sold at outlet price, respectively the products mentioned in Annex 3, marketed by the Organizer online and in the participating outlet stores listed in Annex 2, namely the OUTLET stores in Fashion House Pallady and Fashion House Militari, within the limit of available stock.
  2. The detailed list of participating products, respectively a selection of seasonal products from the outlet collections, 2025 collections and the following collections, is described in Annex 3. The full list of participating outlet products can be found in Annex 3.
  3. The Organizer shall have no further liability or obligation towards persons who purchase participating products or place orders after the Campaign end date.

 

ART. 5. MECHANISM OF THE PROMOTIONAL CAMPAIGN

  1. The Campaign is addressed to the public who, subject to the purchase of eligible products according to Annex 3, purchase made through the online platform available on ro.tommy.com and in the participating stores according to Annex 2, shall benefit from:
  2. 20% discount on the selection of eligible outlet products from Annex 2 and marked with this discount percentage.
  3. 30% discount on the selection of eligible outlet products from Annex 2 and marked with this discount percentage.
  4. The discounts referred to under points a) and b) are applicable to the outlet selling price of the eligible purchased products.
  5. The discount is calculated automatically in the online system when purchasing eligible products or at checkout for eligible products in the stores participating in the Campaign, during the Campaign period.
  6. In the event of potential malfunctions of the ro.tommy.com website or of the management system, including human errors, resulting in the price not being adjusted according to the promotional Campaign and the discount applicable during the Campaign period, the Organizer reserves the right to cancel the respective Order and shall inform the customer accordingly. The customer accepts and agrees that they shall have no right of objection or any other claims regarding the products subject to orders that are the result of or contain functional errors, including human errors. Thus, the Organizer reserves the right to cancel orders placed erroneously, for example: derisory price caused by technical or human errors, etc.

 

ART. 6. LIABILITY

Participation in the Campaign implies knowledge and acceptance of this Regulation. The Organizer is not responsible for:

  • the impossibility of participation due to technical reasons or reasons beyond its control;
  • stock depletion before the end of the Campaign;
  • any malfunctions of the online platform or IT systems.

 

ART. 7. TERMINATION OF THE CAMPAIGN

  1. The Campaign may end before the deadline by unilateral decision of the Organizer or in case of force majeure, with public notification through the same communication channels used at launch.
  2. In the event of termination of the promotions or modification of the conditions, brought to the attention of customers by publication on the company website and in the participating stores, the Organizer shall have no obligation towards customers to pay any amount as compensation or any similar payment.

 

ART. 8. DISPUTES AND APPLICABLE LAW

Disputes between the Organizer and participants shall be settled amicably, and failing an agreement, by the competent courts of Romania, at the Organizer’s registered office.

 

ART. 9. FORCE MAJEURE

Force majeure events exempt the Organizer from liability, according to art. 1351 of the Civil Code. Communication of the force majeure event shall be made on the official website ro.tommy.com within 5 working days from the occurrence of the event.

 

ART. 10. MISCELLANEOUS

Complaints related to the Campaign may be submitted via the cotact form on ro.tommy.com until the Campaign end date, at sarkkrom@sarkkrom.ro, or in the participating stores.

 

FINAL PROVISIONS

This Regulation, together with its annexes — Annex 1 – Data Protection, Annex 2 – Participating Stores, Annex 3 – List of Participating Products — forms an integral part thereof.

The Organizer reserves the right to amend this Regulation at any time, by addendum, brought to the attention of the public through the same official channels.

ANNEX 1 – PERSONAL DATA PROTECTION GDPR

  1. Data Controller

The Organizer acts as data controller according to Regulation EU 2016/679 GDPR for the processing of personal data of the Campaign participants.

 

  1. Purposes of Processing

The personal data collected and used in the context of organizing and running the Campaign is processed for:

  • organizing and running the promotional Campaign;
  • sending commercial communications and marketing materials, such as offers regarding the Organizer’s products, invitations to participate in contests, surveys, questionnaires or other similar communications, with the participant’s prior consent;
  • concluding and executing product purchase contracts;
  • participation in the Campaign, handling complaints and requests from participants, including delivery, invoicing, product returns and settlement of any disputes;
  • enforcing the Regulation, including for defense in court or other judicial / administrative proceedings, investigation of possible breaches, reports, analyses and statistical studies regarding the success of marketing campaigns;
  • archiving and data retention activities, if required by law.

 

  1. Legal Basis for Processing

The processing of personal data is carried out based on:

  • the participant’s consent, art. 6(1)(a) GDPR;
  • performance of a contract to which the data subject is a party, art. 6(1)(b) GDPR;
  • the legitimate interests of the Organizer, art. 6(1)(f) GDPR;
  • where consent represents the legal basis, data subjects have the right to withdraw it at any time, without affecting processing based on other legal grounds.

 

  1. Source and Recipients of Data

The data may be disclosed to:

  • the Organizer’s partners, acting as controllers or processors;
  • public notaries and lawyers appointed to provide assistance in organizing and running the Campaign;
  • service providers, including courier and mobile phone service providers;
  • public authorities or other companies within the Group, where there is an appropriate legal basis, such as legal obligation, consent or legitimate interest.

 

  1. Data Retention Period

The data shall be retained for the duration of the Campaign plus an additional period of at least 3 years, corresponding to the limitation period for legal actions and in accordance with financial-accounting and legal archiving obligations.

 

  1. Rights of Data Subjects

Data subjects benefit from the following rights:

  • Right of access – confirmation of data processing and information regarding the purpose, categories, recipients and retention period;
  • Right to rectification – correction or completion of incomplete data;
  • Right to erasure – where the data is no longer necessary, consent has been withdrawn or processing is unlawful;
  • Right to withdraw consent and right to object – for processing based on consent or legitimate interest, including marketing and profiling;
  • Right to restriction of processing – in situations such as contesting the accuracy of the data, unlawful processing, or during the verification period of requests;
  • Right to data portability – receiving the data in a structured, usable and transferable format to another controller, where technically possible.
