CAMPAIGN REGULATIONS

“MID-SEASON” 2026

ART. 1. ORGANIZER AND REGULATIONS

(1) The organizer of the “MID-SEASON” promotional campaign, hereinafter referred to as the “Campaign” or the “Promotion”, is SARKKROM TRADING S.R.L., headquartered in Bucharest, Sector 1, Calea Floreasca no. 246C, Sky Tower Building, 34th floor, units A and A1, registered with the Bucharest Trade Register under no. J2007006719400 dated 02.04.2007, having tax identification number 21493505.

(2) Participants in the Campaign are required to comply with the terms and conditions of these Official Regulations, hereinafter referred to as the “Official Regulations”.

(3) The Official Regulations are drafted and made available to the public in accordance with applicable legislation and are available free of charge to any requester throughout the Campaign period through the following methods:

  • by accessing the campaign link available on the official website ro.tommy.com;
  • in the participating stores, on the information tablets made available.

(4) The Organizer reserves the right to amend these Regulations during the Campaign period, as well as to suspend or terminate the Campaign, provided that the public is officially informed in the same manner as the initial communication, at least 24 hours before the amendments become effective.

(5) Participation in the Campaign implies acceptance of the Regulations by the participants, who are required to fully comply with all established terms and conditions.

(6) Online participants understand and accept that the website may only be used in compliance with the terms and conditions and after reviewing the Privacy Policy.

 

ART. 2. CAMPAIGN PERIOD AND AREA OF VALIDITY

(1) The promotional campaign will take place for online purchases and in participating stores in Romania, excluding outlet stores, namely: Tommy Hilfiger Baneasa Shopping City, Bucuresti Mall, AFI Cotroceni Mall, CityPark Constanta, Iulius Mall Cluj, Palas Iasi, Promenada Mall Craiova, Promenada Mall Sibiu and AFI Brasov Mall, according to Annex 2. The eligible products are mentioned in Annex 3, an integral part of these Regulations, namely products from the PSP26, SP26 and CORE collections.

(2) The promotional campaign will run between 07.05.2026 – 17.05.2026.

(3) After 17.05.2026, Sarkkrom Trading SRL shall no longer bear any responsibility and shall assume no obligation in relation to any circumstance that may lead interested persons to conclude that the promotional campaign is still valid or ongoing.

(4) All products granted within this promotional campaign must be purchased in accordance with the provisions of these Regulations; otherwise, they shall no longer be owed by the Organizer.

(5) The promotion is valid while stocks last.

 

ART. 3. RIGHT TO PARTICIPATE IN THE CAMPAIGN

(1) The promotional campaign is addressed to the general public, to all individuals, both loyalty members and non-members, who are at least 18 years old at the start date of the Campaign, including Romanian citizens or foreign citizens residing in Romania with permanent residence / domicile in Romania, and who accept the terms and conditions of these Regulations, hereinafter referred to as the “Participants”, by making eligible purchases according to the campaign conditions.

(2) The Organizer reserves the right to eliminate any fraud attempts by restricting participation in this promotional campaign for persons attempting to commit fraud.

(3) By participating in the Campaign, participants express their consent for their personal data to be processed by Sarkkrom Trading S.R.L. on its own behalf, under the conditions provided in Annex 1 to these Regulations.

(4) Employees of the Organizer are not eligible to participate in the Campaign.

 

ART. 4. PARTICIPATING PRODUCTS

(1) The Campaign applies to the purchase of products from the product collection provided under Art. 2 para. (1) of the Regulations, namely Annex 3, eligible products sold by the Organizer in participating stores and online, while stocks last.

(2) The detailed list of participating products is included in Annex 3.

(3) The Organizer shall have no further responsibility or obligation towards persons purchasing participating products or placing orders after the Campaign has ended. In physical stores, the Campaign ends at the store closing time, according to the displayed commercial schedule.

ART. 5. MECHANISM OF THE PROMOTIONAL CAMPAIGN

(1) The Campaign is addressed to customers who, subject to meeting the campaign conditions, purchase one or more participating products according to Annex 3, in participating stores in Romania or through the online platform on ro.tommy.com, and will benefit from discounts of up to 40% off the selling price, as follows:

  1. a) a 40% discount applied to the selling price of eligible products purchased from the PSP26 collection;
    b) a 30% discount applied to the selling price of eligible products purchased from the SP26 collection;
    c) a 30% discount applied to the selling price of eligible products purchased from the CORE collection.

(2) The discount is automatically calculated in the online system upon payment for participating products during the Campaign period or applied at checkout for in-store purchases.

(3) For the avoidance of doubt, in the case of purchasing several products of which only some are eligible, the discount shall apply only to the eligible products according to these Regulations.

(4) In the event of any malfunction of the ro.tommy.com website or management system, including human errors, resulting in the price not being adjusted according to the promotional campaign and the applicable discount, the Organizer reserves the right to cancel the respective order and inform the customer accordingly. The customer accepts and agrees that they shall have no right to object or make any claims regarding products subject to orders resulting from or containing operational errors, including human errors. Therefore, the Organizer reserves the right to cancel incorrectly placed orders, such as derisory prices caused by technical or human errors, etc.

 

ART. 6. LIABILITY

Participation in the Campaign implies knowledge and acceptance of these Regulations. The Organizer is not responsible for:

  • impossibility to participate due to technical reasons or reasons beyond its control;
  • stock depletion before the end of the Campaign;
  • any malfunctions of the online platform or IT systems.

 

ART. 7. TERMINATION OF THE CAMPAIGN

(1) The Campaign may end before the announced date through the unilateral decision of the Organizer or in case of force majeure, with public notification through the same communication channels used at launch.

(2) In the event of termination of the promotions or modification of the conditions communicated to customers through publication on the company website and in participating stores, the Organizer shall have no obligation towards customers to pay compensation or similar amounts.

 

ART. 8. DISPUTES AND APPLICABLE LAW

Any disputes between the Organizer and participants shall be settled amicably, and in the absence of an agreement, by the competent courts in Romania at the Organizer’s headquarters.

 

ART. 9. FORCE MAJEURE

Force majeure events exempt the Organizer from liability, in accordance with Art. 1351 of the Romanian Civil Code. Communication regarding a force majeure event shall be made on the official website ro.tommy.com within 5 business days from the occurrence of the event.

 

ART. 10. MISCELLANEOUS

Complaints regarding the Campaign may be submitted through the contact form available on ro.tommy.com until the end date of the Campaign, via email at sarkkrom@sarkkrom.ro, or in participating stores.

 

FINAL PROVISIONS

These Regulations, together with their annexes — Annex 1: Data Protection, Annex 2: Participating Stores, Annex 3: List of Participating Products — form an integral part hereof. The Organizer reserves the right to amend these Regulations at any time through an addendum communicated to the public through the same official channels.

ANNEX 1 – PERSONAL DATA PROTECTION (GDPR)

  1. Data Controller

The Organizer acts as data controller in accordance with Regulation (EU) 2016/679, GDPR, for the processing of personal data of Campaign participants.

  1. Purposes of Processing

The personal data collected and used in the context of organizing and conducting the Campaign are processed for:

  • organizing and conducting the promotional campaign;
  • sending commercial communications and marketing materials, such as offers regarding the Organizer’s products, invitations to participate in contests, surveys, questionnaires or other similar communications, with the participant’s prior consent;
  • concluding and performing product purchase agreements;
  • participation in the Campaign, handling complaints and requests from participants, including delivery, invoicing, product returns and dispute resolution;
  • implementation of the Regulations, including court defense or other judicial / administrative proceedings, investigation of potential violations, reporting, analyses and statistical studies regarding the success of marketing campaigns;
  • archiving and data retention activities where required by law.
  1. Legal Basis for Processing

The processing of personal data is carried out based on:

  • the participant’s consent, Art. 6(1)(a) GDPR;
  • the performance of a contract to which the data subject is party, Art. 6(1)(b) GDPR;
  • the legitimate interests of the Organizer, Art. 6(1)(f) GDPR.

Where consent represents the legal basis, data subjects have the right to withdraw it at any time, without affecting processing based on other legal grounds.

  1. Source and Recipients of Data

The data may be disclosed to:

  • the Organizer’s partners, acting as controllers or processors;
  • public notaries and lawyers appointed to assist in organizing and conducting the Campaign;
  • service providers, including courier and mobile telephony services;
  • public authorities or other Group companies, where there is an appropriate legal basis, such as legal obligation, consent or legitimate interest.
  1. Data Retention Period

The data will be retained for the duration of the Campaign plus an additional minimum period of 3 years, corresponding to the statute of limitations for legal actions and according to financial-accounting and legal archiving obligations.

  1. Rights of Data Subjects

Data subjects benefit from the following rights:

  • Right of access – confirmation of data processing and information regarding purpose, categories, recipients and retention period;
  • Right to rectification – correction or completion of incomplete data;
  • Right to erasure – where the data are no longer necessary, consent has been withdrawn or processing is unlawful;
  • Right to withdraw consent and right to object – for processing based on consent or legitimate interest, including marketing and profiling;
  • Right to restriction of processing – in situations such as contesting data accuracy, unlawful processing, or during verification of requests;
  • Right to data portability – receiving data in a structured, commonly used and machine-readable format and transmitting them to another controller, where technically feasible.
